CDE: Questions, concerns, confirmation about mask wearing (082820)

Dear charter school emergency contact list, 

As schools are reopening, our office has received some questions and concerns about mask wearing in schools. As such, we wanted to send some quick information to school leaders that we hope can help address concerns that they may be confronting. Your free time is scarce right now, and we hope this guidance/these talking points can help preserve some of that free time. Please see below: 

  1. Currently, Colorado is under an executive order that sets specific requirements for mask wearing in school. Those requirements are legal requirements and need to be followed by the school. The requirements can be found here:
  2. This site provides some helpful general guidance related to implementing health requirements in a school - including implementing the mask order:
  3. If charter leaders are being asked for guidance from their board about whether the board has discretion on this matter (since, often, charter schools are allowed local flexibility to make school-based decisions), leaders should remind their board members on a couple of points:
    1. In this situation, they do not have applicable waivers and so the school is required to follow the orders 
    2. Board members, in their role, have a “duty of compliance” to the organization to comply with all applicable federal, state, and local laws, including all executive orders currently in effect.
